In today’s Judgment regarding the Application of the Convention on the Prevention and Punishment of the Crime of Genocide (Bosnia and Herzegovina v. Serbia and Montenegro), the International Court of Justice (ICJ) affirmed that it had jurisdiction to deal with the case.

The Court found that Serbia had violated its obligation under the Genocide Convention to prevent genocide in Srebrenica, as well as that it had violated its obligations under the Convention by having failed fully to co-operate with the International Criminal Tribunal for the former Yugoslavia (ICTY).
It would seem that the Krajina Serbs have a very strong case against Croatian state regarding genocide
"However, this does not mean that acts described as “ethnic cleansing” may never constitute genocide, if they are such as to be characterized as, for example, “deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part”, contrary to Article II, paragraph (c), of the Convention, provided such action is carried out with the necessary specific intent (dolus specialis), that is to say with a view to the destruction of the group, as distinct from its removal from the region."
- the Croatian state knew exactly what would happend when they commited genocide in operation storm - they had tested out small operations training its troops on the battlefields of Bosnia and staging quick, limited offensives at the strategic edges of UN-protected areas (most infamous being the Medak Pocket attack and therefore premeditated the genocide in Krajina.
